Welcome to Focus! These Terms of Service ("Terms") govern your use of the Focus mobile application (the "App") operated by Xerxia Studios ("we", "us", or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1. License to Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device for your personal, non-commercial use.
You may not:
- Copy, modify, or distribute the App or its content
- Reverse engineer, decompile, or disassemble the App
- Remove any copyright or proprietary notices from the App
- Transfer your rights to use the App to another person
- Use the App in any way that violates applicable laws or regulations
2. Account Registration
Some features of the App may require you to create an account. When creating an account, you agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Promptly update your information if it changes
- Accept responsibility for all activities under your account
We reserve the right to suspend or terminate your account if we suspect any unauthorized use or violation of these Terms.
3. Subscription and Payments
The App offers both free and premium features. Premium features require a subscription, which may be offered as:
- Monthly subscription
- Annual subscription
- Lifetime purchase
Subscriptions are processed through Apple's App Store. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase. Refunds are handled according to Apple's refund policies.
4. User Content
You retain ownership of any content you create within the App, including tasks, notes, and other data ("User Content"). By using the App, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing the App's services to you.
You are solely responsible for your User Content and agree not to create content that:
- Is illegal, harmful, or offensive
- Infringes on intellectual property rights of others
- Contains malicious code or harmful data
5. Intellectual Property
The App, including its design, features, functionality, and content, is owned by Xerxia Studios and is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.
6. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to our Privacy Policy.
7. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
We are not responsible for any productivity outcomes, missed deadlines, or other consequences arising from your use of the App. The App is a tool to assist with time management and task organization, and results may vary.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, XERXIA STUDIOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
9. Indemnification
You agree to indemnify, defend, and hold harmless Xerxia Studios and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the App or violation of these Terms.
10. Changes to the App
We reserve the right to modify, suspend, or discontinue the App (or any features or content) at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or through other communications. Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Xerxia Studios is established, without regard to its conflict of law provisions.
